Terms and Conditions
1. These terms and our agreement with you
1.1 Who we are. Designed by Wolfe is a multidisciplinary art and design studio offering custom artwork commissions, paid creative content, and updates through newsletters. All enquiries, communications, and artworks are personally managed by the artist.
1.2 What these terms cover. These Terms and Conditions govern your engagement with Designed by Wolfe for commissioned artwork, creative services, or paid content. Along with any applicable enquiry forms and our Privacy Notice, they collectively constitute the terms of our agreement. No additional terms, whether spoken (including informal assurances or statements) or written, shall apply unless explicitly agreed to in writing by the artist. All bookings, purchases, or commissions accepted by Designed by Wolfe are subject to your full understanding and acceptance of these Terms and Conditions.
1.3 Why you should read these terms and Conditions. Please read these Terms and Conditions carefully before commissioning artwork, purchasing content, or using any services provided by Designed by Wolfe. These terms explain who we are, how you can engage with us, how we may modify or end our agreement with you, and what your rights and responsibilities are throughout the process.
1.4 Who these terms apply to. These Terms and Conditions apply to any individual or business engaging Designed by Wolfe, whether you are commissioning artwork for yourself, on behalf of someone else, or purchasing other content or services. They also apply to any third-party businesses involved in fulfilling or supporting our services, such as printing companies, framers, couriers, or delivery providers. Certain sections within these terms may apply specifically to individual consumers or to businesses, as clearly indicated where relevant.
2. Commissioning Artwork with Designed by Wolfe & Your Responsibilities
2.1 How to Commission Artwork. To commission a piece from Designed by Wolfe, you will be required to complete a commission request form or make a payment through one of our approved channels. Once your enquiry is reviewed, we will confirm details and availability directly with you.
2.2 When our Agreement Begins. Our agreement begins when we send you written confirmation by email, acknowledging your commission request, receipt of the agreed deposit or full payment, and any required details for the project. Whichever of these occurs first marks the start of our formal engagement.
2.3 Receiving Project Information. All communication, including updates and essential information about your commissioned artwork, will be sent via email unless otherwise agreed. It is your responsibility to ensure that your contact details are accurate and kept up to date. Your personal data will be processed and stored in accordance with our Privacy Notice. By submitting your information, you consent to Designed by Wolfe processing your data for the purpose of fulfilling your commission.
2.4 How to Contact Us. For all enquiries relating to your artwork commission, whether it’s a creative question, a timeline update, or a general query, please email directly at designedbywolfe@gmail. Phone communication can be arranged upon request if necessary.
2.5 Your Commitment to the Creative Process. By entering into an agreement with Designed by Wolfe, you agree to provide timely feedback, clear direction where needed, and any necessary materials (e.g. references or written descriptions). Your co-operation helps ensure a smooth, creative process and timely delivery of the commissioned artwork.
2.6 Our Commitment to You. Designed by Wolfe will carry out each commission with professional care, artistic integrity, and attention to detail, ensuring the final work meets the agreed specifications and creative brief.
3. Paying for Commissions
3.1 Payment amount and deposits. The cost of commissioning artwork from Designed by Wolfe will be confirmed in writing via email, invoice, or commission form and will depend on factors such as complexity, size, medium, and intended usage. A deposit equal to one-quarter (1/4) of the final agreed-upon price is required to secure the project. This deposit is non-refundable if the client chooses to cancel the commission at any stage. Both the client and Designed by Wolfe reserve the right to cancel the commission at any time; however, if cancellation is initiated by the client, the deposit will not be returned. The specific payment schedule will be agreed upon in advance, and full payment must be received before the finished artwork is dispatched or delivered. By confirming the commission or submitting payment, the client agrees to these terms and is responsible for meeting all agreed payment deadlines.
3.2 Return Policy. All sales of commissioned artwork by Designed by Wolfe are final. Due to the custom and personal nature of commissioned pieces, there is no return or refund policy. Once the finished artwork has been sent or delivered to the client, it is no longer under the care or responsibility of Designed by Wolfe and cannot be returned or exchanged. Please ensure you are fully satisfied with all details before final payment and shipment.
4. Cancellation of Commissions by you
4.1 Process of Commissioning. Once a clear conversation has been established between you (the client) and Designed by Wolfe through email, phone call, or messaging, and the details of the artwork have been thoroughly discussed and agreed upon, a deposit is required to confirm the commission. Once the deposit is received, the artist will begin developing initial concepts and designs for the piece. During the creation process, the artist may reach out for additional input or feedback to ensure the work aligns with your expectations. Once the artwork is completed, detailed photographs will be shared with you for final approval. If you confirm you are satisfied, the remaining balance must be paid in full before the artwork is dispatched. Should you choose to cancel the commission after the deposit is paid, the deposit will not be refunded, as it covers the time and creative development already undertaken.
4.2 Cancellation and fees. If you decide to cancel your commission before the deposit is paid, no charges will be applied. If cancellation occurs after the deposit has been paid but before the piece is completed, the deposit will be retained by Designed by Wolfe to cover time, materials, and initial design work, but no further payment will be required. If cancellation takes place after the piece is completed and photos have been provided, the deposit will still be non-refundable, but you will not be charged the remaining balance. However, once the finished artwork has been dispatched for delivery, no refund of any kind will be available. Similarly, if cancellation is attempted after the artwork has been delivered, no refund—full or partial – will be offered, as the commission is considered fulfilled and no longer the responsibility of Designed by Wolfe.
5. Cancellation of Commissions by us
5.1 Our Right to Cancel a Commission. Designed by Wolfe reserves the right to cancel a commission agreement under certain circumstances. These may include events beyond our control that prevent us from fulfilling the commission, unforeseen personal or professional matters, or a situation where we determine that we are unable to complete the piece to our usual standard. In such cases, if a deposit has already been received, it will be refunded in full. We may also, where appropriate, offer to reschedule or suggest an alternative solution, but we will not be under obligation to do so.
5.2 Additional Grounds for Cancellation. We also reserve the right to cancel a commission at any stage if:
- In our opinion, the client engages in any behaviour deemed inappropriate, aggressive, discriminatory, or otherwise offensive – whether through email, phone, or other correspondence. In such cases, a warning will be issued in writing (via email), outlining the nature of the issue and expectations for continued engagement. If the behaviour continues after notice, Designed by Wolfe may cancel the commission, and the deposit will not be refunded.
- If the client fails to make the required deposit or final payment when due, or breaches any agreed terms of the commission process, we also reserve the right to terminate the agreement. In this event, any deposit already paid will be retained, and no further charges will be made.
- If the cancellation is initiated by Designed by Wolfe without any fault on the part of the client, any fees already paid, including the deposit, will be refunded in full. However, in the event that the cancellation arises due to the client’s conduct or failure to meet agreed obligations, no refund will be issued.
6. Commission Requirements
6.1 Clear Brief or Concept Description. In the commission form, clients are required to provide a clear written description of their commission request. This includes the desired theme, subject, mood, size, and any specific elements to include or avoid. Reference images are highly encouraged. This helps ensure the final piece aligns with your vision.
6.2 Deposit Requirement. A non-refundable deposit of 25% of the final agreed price is required before the design work begins. This secures your commission slot and covers initial development time. No formal development will commence until the deposit is received.
6.3 Communication & Revisions. All communication should take place via email, phone, or Microsoft Teams. Clients are welcome to request multiple minor revisions during the design phase, as the artist will actively seek preferences and feedback at the outset and throughout the creative process. Please note that significant changes requested after work has begun may incur additional fees. Designed by Wolfe will provide progress updates as needed and may reach out for feedback during development to ensure the final result aligns with your vision.
6.4 Timeline and Completion. A rough estimate for completion will be provided once the commission is confirmed. Please note that timelines vary based on complexity and workload. Clients will be notified of any significant delays.
6.5 Final Payment and Delivery. The remaining balance is due once the final artwork is approved via photo confirmation. Full payment must be received before the finished piece is dispatched. No artwork will be shipped or delivered until payment is complete.
6.6 Usage Rights and Copyright. Unless otherwise agreed in writing, all artwork remains the copyright of Designed by Wolfe. Commissions are for personal use only and may not be reproduced, edited, resold, or used commercially without prior consent and appropriate licensing.
6.7 No Refund After Completion. Once the final piece has been approved, paid for, and delivered, no refunds or returns will be accepted. Ownership of the physical artwork transfers to the client upon delivery and Designed by Wolfe is no longer responsible for the piece once it has been dispatched. However, all intellectual property and copyright in the artwork remain the sole property of Designed by Wolfe, unless otherwise agreed in writing.
6.8 Shipping and Delivery. Shipping fees may be added depending on size, destination, or courier choice. Tracking information will be provided when available. Designed by Wolfe is not liable for loss or damage once the artwork has been dispatched.
6.9 Client Conduct. Designed by Wolfe reserves the right to refuse or cancel a commission at any point due to abusive communication, repeated unresponsiveness, or breach of agreed terms.
7. Timing and Turnaround
7.1 Average Timing and Turnaround. By commissioning a piece from Designed by Wolfe, the client acknowledges and agrees that the average turnaround time for an A4 drawing is approximately three weeks from the date the deposit is received, and the final concept is agreed upon. The client accepts that this timeframe is an estimate and may be shorter or longer depending on the size and complexity of the commission, or the artist’s current workload. For larger or more intricate pieces (e.g., A3 or above), extended timelines should be expected. The client agrees to remain responsive during the design process to avoid unnecessary delays. While every effort will be made to meet the estimated timeline, the artist cannot guarantee exact delivery dates and is not liable for delays beyond their control.
7.2 Client Communication and Delays. The client agrees to maintain timely communication throughout the creation process. If Designed by Wolfe contacts the client during the commission for clarification, feedback, or approval of design elements, and the client fails to respond within a reasonable timeframe (typically 3–5 working days), the overall timeline for completion may be extended accordingly. The client understands and accepts that delayed responses can directly impact the final delivery date, and such delays are not the responsibility of Designed by Wolfe.
8. Buying Artwork with Designed by Wolfe & Your Responsibilities
8.1 How to Purchase Artwork. To purchase artwork from Designed by Wolfe, you may do so through our official online shop, social media links, approved third-party platforms, or by contacting us directly via email. All product listings will include the relevant details, pricing, and available payment methods. Once payment is completed, the piece is considered reserved for you.
8.2 When Our Agreement Begins. Our agreement with you begins when we send written confirmation of your order via email, acknowledging receipt of payment and confirming dispatch or collection details. At this point, a binding agreement is in place for the sale and delivery of the selected artwork.
8.3 Receiving Order Information. All essential communication, including order confirmations, delivery details, and updates, will be sent via email unless otherwise agreed. It is your responsibility to ensure your contact details are accurate and up to date. Your personal data will be handled in accordance with our Privacy Policy. By placing an order, you consent to Designed by Wolfe processing your information for the purposes of fulfilling and dispatching your purchase.
8.4 How to Contact Us. If you have any queries about your purchase, whether regarding payment, shipping, or the artwork itself, you can contact Designed by Wolfe at designedbywolfe@gmail.com. If necessary, phone communication can be arranged upon request.
8.5 Your Responsibilities as a Buyer. By purchasing artwork, you agree to review all product descriptions and images carefully before completing your order. You are also responsible for providing a correct delivery address and any relevant delivery instructions. Once the artwork is dispatched, Designed by Wolfe is no longer responsible for delays or errors caused by incorrect information or postal service issues.
8.6 Our Commitment to You. Designed by Wolfe will ensure all purchased artworks are prepared, packaged, and shipped with the utmost care. We are committed to delivering high-quality pieces as described, and to providing a smooth and professional buying experience from confirmation to delivery.
9. Paying for Listed Artwork
9.1 Payment Terms. The price for each artwork available for purchase from Designed by Wolfe will be clearly stated at the point of sale, whether via our website, email communication, invoice, or an approved sales platform. Full payment is required upfront before any artwork is dispatched. By submitting payment, the buyer confirms their intention to purchase the selected artwork and agrees to these terms. All prices are final unless a specific agreement is made in writing. Once payment has been received and confirmed, no adjustments, partial payments, or cancellations will be permitted.
9.2 Return Policy. All sales of artwork from Designed by Wolfe are final. Due to the original and handcrafted nature of each piece, we do not offer refunds or accept returns under any circumstances. Once the artwork has been shipped or handed over to the buyer, ownership transfers and Designed by Wolfe is no longer responsible for the piece. Buyers are encouraged to review all photographs, descriptions, and relevant details prior to completing their purchase to ensure satisfaction.
10. Cancellation of Purchase by you
10.1 Purchase Process. Once a buyer expresses interest in acquiring original artwork from Designed by Wolfe, the transaction is confirmed through full payment made via an approved sales channel or written agreement. Prior to purchase, the buyer is encouraged to thoroughly review all provided information about the piece, including images, dimensions, medium, and price. If requested, additional details may be provided to ensure clarity. Upon receipt of payment, the artwork will be carefully prepared for dispatch. Designed by Wolfe may contact the buyer during this stage to confirm delivery preferences or address any final considerations. Ownership of the artwork transfers to the buyer upon shipment or handover.
10.2 Cancellation and Refund Policy. If a buyer chooses to cancel the purchase before payment has been made, no charges will apply. However, once payment has been received and the sale confirmed, the transaction is considered final. Designed by Wolfe does not offer refunds or accept cancellations after payment is made. If the artwork has already been dispatched or delivered, no refund, partial or full, will be available. Buyers are therefore encouraged to make their purchasing decision carefully and ensure they are fully satisfied with all aspects of the piece prior to completing payment.
11. Cancellation of Purchase by us
11.1 Right to Cancel a Purchase. Designed by Wolfe reserves the right to cancel a purchase agreement at any stage if circumstances arise that prevent the artist from delivering the work. These may include unforeseen personal, professional, or logistical challenges, or situations where it becomes clear the artwork cannot be delivered to the expected standard. If cancellation is initiated by Designed by Wolfe under such circumstances, and no fault lies with the client, any payment already received will be refunded in full. While we may offer to reschedule or propose an alternative arrangement, we are not obligated to do so.
11.2 Additional Grounds for Cancellation. Designed by Wolfe also reserves the right to cancel a commission if:
- The client engages in behaviour that is inappropriate, abusive, discriminatory, or otherwise offensive in any form of communication, including email, phone, or messaging. A written warning will be issued via email, clearly outlining the concerns and expectations moving forward. If the behaviour continues, the commission may be cancelled without refund.
- The client fails to provide the full payment by the agreed deadlines, or otherwise breaches the terms of the agreement. In such cases, the deposit will be retained, and no further charges will apply.
- The cancellation results from a failure on the part of the client to respond to communications in a timely manner or to provide essential information needed to progress the commission.
In all cases where cancellation is due to client conduct or failure to meet obligations, no refund will be issued. Where cancellation is due solely to the decision of Designed by Wolfe, without any breach or fault by the client, a full refund of any fees paid will be issued.
12. Purchasing Artwork Requirements
12.1 Artwork Description and Information. All available artworks for sale by Designed by Wolfe will include a clear description detailing size, medium, subject matter, and price. Additional photographs or information can be provided upon request prior to purchase to help the client make an informed decision.
12.2 Payment and Deposit. Full payment is required at the time of purchase. No artwork will be marked as sold, reserved, or dispatched until payment has been received in full through one of Designed by Wolfe’s approved payment methods. By completing the purchase, the client agrees to these terms and accepts responsibility for ensuring timely payment.
12.3 Communication and Confirmation. All purchase communications should be made via email (designedbywolfe@gmail.com) unless otherwise agreed. Designed by Wolfe may confirm final purchase details with the buyer before dispatch to ensure accuracy in delivery address and satisfaction with the condition of the piece.
12.4 Timeline for Dispatch. While most purchased artwork will be dispatched within 3–7 business days after full payment is received, timeframes may vary based on packaging requirements, courier schedules, or destination. The buyer will be notified of any delays as soon as possible.
12.5 Final Sale and No Return Policy. All sales are final. Once the artwork has been paid for and dispatched, ownership of the physical piece transfers to the buyer. No returns, refunds, or exchanges will be accepted unless otherwise agreed in writing prior to purchase. Designed by Wolfe is not responsible for any change of mind after dispatch. Please note that while the buyer owns the physical artwork, all intellectual property and copyright remain the exclusive property of Designed by Wolfe, unless otherwise agreed in writing.
12.6 Copyright and Usage. All sold artworks remain the intellectual property of Designed by Wolfe unless otherwise agreed. Purchase of original work does not grant rights for reproduction, resale, or commercial use. Artworks are for personal use and display only unless licensed separately in writing.
12.7 Shipping and Delivery. Shipping fees may apply depending on the size, destination, and courier chosen. Tracking details will be provided where available. Designed by Wolfe takes care to package all artworks securely, but is not liable for any damage, delay, or loss once the artwork has been handed over to the delivery service.
12.8 Client Conduct. Designed by Wolfe reserves the right to refuse or cancel a sale at any time if the buyer engages in abusive, inappropriate, or unprofessional communication, or fails to meet the agreed terms of payment.
13. Our Liability to You
13.1 Liability. Designed by Wolfe does not limit or exclude liability where it would be unlawful to do so. This includes liability for personal injury or death caused by negligence, fraud or fraudulent misrepresentation, or any matter for which exclusion or limitation of liability would be contrary to applicable law.
13.2 Limitations of Liability. Subject to the above, Designed by Wolfe shall not be held liable for any indirect or consequential losses you may incur as a result of your commission. This includes, but is not limited to, loss of profits or anticipated earnings, interruption of business, loss or corruption of data or files, or reputational damage. Once a piece is completed and dispatched, responsibility for the artwork passes to the client, and Designed by Wolfe holds no liability for damage, loss, or misuse occurring after dispatchment.
13.3 Total Liability. In all cases, Designed by Wolfe’s total liability, whether in contract, tort (including negligence), or otherwise, shall be limited to the total amount paid for the specific commission in question.
13.4 External Factors Beyond Our Control. Designed by Wolfe shall not be liable for delays or failure to perform obligations under the agreement due to circumstances beyond our reasonable control. This includes, but is not limited to, acts of nature, postal delays, loss or damage during shipping, communication outages, strikes, pandemics, acts of vandalism, or other force majeure events.
14. Legal Notice & Intellectual Property Terms
14.1 Severability. If any part of our agreement with you is found by a court to be unlawful or unenforceable, the remaining provisions will continue to apply in full and remain legally binding.
15. Ownership of Intellectual Property
15.1 Who owns the rights. All copyright and intellectual property rights in Designed by Wolfe’s original artworks, commissioned pieces, and any related materials (in any format or medium) remain the sole and exclusive property of Designed by Wolfe, unless expressly agreed otherwise in writing.
15.2 What you can’t do. You may not reproduce, copy, distribute, license, display, or commercially exploit any artwork or content created by Designed by Wolfe without our prior written consent. This includes sharing or reselling any commissioned or purchased artwork, whether physically or digitally. Ownership of a physical artwork does not transfer the underlying copyright or intellectual property rights.
15.3 What you can do. When you purchase or commission a piece, you are granted ownership of the physical artwork for personal use and enjoyment only. Commissioned clients may share images of their piece online or privately, provided proper credit is given to Designed by Wolfe and the use is non-commercial. Any further use requires explicit written permission.
15.4 Third Parties and Transfers. This agreement is between you and Designed by Wolfe. No other party has rights under this agreement. You or your sponsor may not transfer your rights or obligations under this agreement without our prior written consent. We may transfer or assign our rights under this agreement at any time, without requiring your consent.
15.5 Delays in Enforcement. If we choose not to immediately enforce part of this agreement, it does not mean we waive our right to enforce it later. This includes, for example, allowing a grace period before addressing a breach or not acting immediately on a violation.
15.6 Governing Law. This agreement shall be governed by and interpreted in accordance with English law. The English courts shall have exclusive jurisdiction over any disputes arising from or relating to our agreement with you.
